ExamWizardz provides an online study platform for IT certification preparation, including practice tests, flashcards, video lessons, study articles, and other educational resources. We reserve the right to modify, suspend, or discontinue any part of our service at any time.

ExamWizardz is a study aid and does not guarantee certification exam results.

8. Limitation of Liability

To the maximum extent permitted by law, ExamWizardz shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the service
• Unauthorized access to your account
• Any conduct or content of third parties
• Failed certification exams

9. Indemnification

You agree to indemnify and hold harmless ExamWizardz and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the service or violation of these terms.

10. Termination

We reserve the right to suspend or terminate your account at any time for any reason, including if you breach these Terms of Service. Upon termination, your right to use the service will immediately cease. You may cancel your subscription at any time through your account settings.

11. Third-Party Certifications

ExamWizardz is not affiliated with, endorsed by, or sponsored by CompTIA or any other certification body. All certification names and trademarks are the property of their respective owners. Our practice tests and materials are created independently to help students prepare for certification exams.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these terms will be resolved in the courts located in the United States.

13. Dispute Resolution; Binding Arbitration; Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

Agreement to Arbitrate.You and ExamWizardz agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the service (a "Dispute") will be resolved by binding individual arbitration rather than in court, except that either party may bring qualifying claims in small-claims court. The Federal Arbitration Act governs the interpretation and enforcement of this section.

Arbitration Procedures.The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as modified by these Terms. The arbitrator's award may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver.You and ExamWizardz agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative action. The arbitrator may not consolidate more than one person's claims or preside over any class or representative proceeding.

Jury Trial Waiver. If for any reason a Dispute proceeds in court rather than in arbitration, you and ExamWizardz each waive any right to a jury trial.

30-Day Right to Opt Out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing legal@examwizardz.com with your name and a statement that you wish to opt out of arbitration. Opting out will not affect any other provision of these Terms.

Severability of this Section. If the Class Action Waiver above is found unenforceable as to a particular claim, that claim (and only that claim) will be severed and may proceed in court, while the remainder of this section continues to apply.

14. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes via email or through a prominent notice on our website. Your continued use of the service after such modifications constitutes your acceptance of the updated terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect and enforceable.
